These Terms of Service (“Terms”) govern your use of hosting services provided by Digital Interactive Hosting (“we,” “our,” or “us”). By signing up for or using our hosting services, you (“Client,” “you,” or “your”) agree to these Terms. If you do not agree, you may not use our services.

1. Services Provided

  • We provide cloud-based hosting environments for websites and applications.
  • Servers are provisioned on infrastructure owned and operated by third-party providers. We manage and maintain the server environment but do not own or directly control the hardware.
  • Our responsibility is limited to maintaining server availability, operating system updates, and server-level configurations.

2. Client Responsibilities

  • Website Management: You are solely responsible for managing, maintaining, and updating your website files, applications, plugins, and content hosted on our servers.
  • Security Updates: You are responsible for keeping your website’s code, CMS, and third-party applications up to date to avoid vulnerabilities. We do not take responsibility for hacks, breaches, or downtime caused by outdated software or insecure code.
  • Content: You are fully responsible for the legality and accuracy of all content hosted on your site.
  • Access Credentials: You are responsible for maintaining the confidentiality of login credentials and ensuring authorized access only.

3. Prohibited Uses

You may not use our services for:

  • Hosting or distributing malware, viruses, or malicious code.
  • Hosting content that violates any law, regulation, or intellectual property rights.
  • Spamming, phishing, or sending unsolicited messages.
  • Activities that could disrupt server operations or other hosted clients.
    We reserve the right to suspend or terminate services that violate these conditions.

4. Service Availability

  • While we strive for high uptime and reliability, we do not guarantee uninterrupted service.
  • Scheduled maintenance or third-party provider outages may cause temporary downtime.
  • We are not liable for interruptions caused by factors outside our reasonable control, including third-party failures or client-side misconfigurations.

5. Payments and Billing

  • Fees are billed in accordance with your chosen hosting plan.
  • Payment is required in advance of service. Failure to pay may result in suspension or termination of services.
  • All fees are non-refundable unless otherwise specified.

6. Data Backup & Recovery

  • We may provide limited server-level backups, but you are solely responsible for maintaining backups of your website content and data.
  • We are not liable for data loss, corruption, or restoration failures.

7. Limitation of Liability

  • To the maximum extent permitted by law, Digital Interactive Hosting shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost profits, data loss, or business interruption.
  • Our total liability for any claim arising from your use of our services shall not exceed the amount you paid for the hosting services during the 3 months prior to the claim.

8. Indemnification

You agree to indemnify and hold harmless Digital Interactive Hosting, its employees, and contractors from any claims, damages, or expenses arising out of your use of the services, your content, or your violation of these Terms.

9. Termination

  • You may cancel services at any time by providing written notice.
  • We may suspend or terminate your services immediately if you violate these Terms or fail to make timely payments.
  • Upon termination, your account and data may be deleted without recovery.

10. Governing Law

These Terms are governed by and construed under the laws of the United States and the State of [Insert State].
